The revised and expanded Fifth Edition is designed to provide practical guidance for commercial arbitration practitioners at every level. It provides a clear and comprehensive roadmap for navigating all phases of the arbitral process, including the selection of arbitrators, managing procedural issues, and drafting and enforcing awards.

Reflecting significant developments in arbitration law and practice, this edition incorporates the collective insights of fifty leading arbitrators. Contributors analyze emerging case law, revised institutional rules, and new legislation, while expanding discussion around the complex issues arbitrators face daily.

As arbitration continues to evolve and more practitioners seek to enter the field, the Fifth Edition arrives at a pivotal time. The Guide also addresses the growing use of commercial arbitration in international transactions and the increasing role of the United States as a preferred seat for international arbitration.

Notable additions to the Fifth Edition include:

  • In-depth guidance on data privacy, security, and the responsible use of generative AI

  • Two new appendices addressing arbitrator use of social media and diversity resources

  • A groundbreaking analysis of arbitrability issues

  • Enhanced discussion of fee-related challenges

  • Updated checklists for preliminary conferences and merits hearings

  • Expanded coverage of emergency arbitrators, interim measures, and international arbitration

More than a restatement of arbitration principles, the Guide offers practical, experience-tested strategies for improving the efficiency and effectiveness of the arbitral process. Drawing on real-world cases, the work of leading practitioners, and developments across arbitral institutions, this work serves as an essential resource for anyone engaged in commercial arbitration.
