Medical Malpractice Team Obtains Defense Verdict

Frilot partners Peter E. Sperling and John B. Cazale obtained a defense verdict in a medical malpractice case tried in the 34th JDC for the Parish of St. Bernard.

Frilot’s client was an Emergency Room physician who assessed a 46-year-old decedent who presented complaints of severe back pain to a local emergency room. The defendant physician diagnosed a kidney infection based on the presenting symptoms and discharged the decedent with a prescription for pain medication and an antibiotic. Five hours after discharge, the decedent died of an aortic dissection. A wrongful death action was brought by the seven surviving children.

After a four-day trial the jury returned a verdict in favor of the defendant physician. Napoleon v. Curran, 34th JDC, No. 2019-1015.
